Information Clause

(Privacy Policy)

The protection of your personal data is a matter of particular concern to us. We therefore process your data exclusively on the basis of legal provisions (GDPR, DSAG TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the scope of the website.

  1. Contact Information

If you contact us via form or email, your provided data will be stored by us for six months for the purpose of processing your inquiry and in case of follow-up questions. We will not pass on this data without your specific consent.

  1. Processing and Use of Personal Data
    • We, Mama Matters OG, collect, process, and use your personal data only with your consent and your order and any subsequent warranty claims, as well as for advertising purposes or for ordering for the purposes agreed with you, or if there is another legal basis in accordance with the GDPR, in compliance with data protection and civil law provisions.
    • Personal data is any information concerning personal or factual circumstances of an identified or identifiable natural person, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons, as well as biometric data such as fingerprints.
    • However, you can visit our site without providing any personal information. We only store access data without personal reference, such as: the name of your internet service provider; the page from which you visit us; or the name of the requested file.

This data is evaluated exclusively to improve our offering and does not allow any conclusions to be drawn about your person.

  • Personal data is collected when you voluntarily provide it to us as part of your goods order or when registering for the newsletter. When you sign up for the newsletter, your email address will be used for our own advertising purposes until you unsubscribe from the newsletter. You can unsubscribe at any time.
  • This data will only be passed on to third parties as far as this is legally permissible and for the purpose of contract processing, billing, for marketing purposes, or if you have given your prior consent. For example, within the scope of order processing, the service providers we use (such as transporters, logistics providers, banks) receive the necessary data for order and contract processing. The data passed on may only be used by our service providers to fulfill their task.
  1. Data Storage
    • Please note that for the purpose of simplifying the shopping process and for subsequent contract processing, the webshop operator stores the IP data of the connection owner, as well as the buyer's name, address, and credit card number, as part of cookies.
    • The data you provide is necessary for the fulfillment of the contract. Without personal data, it is not possible to conclude a contract.
    • No data is transferred to third parties. An exception exists for the transfer of credit card data to the processing banks/payment service providers for the purpose of debiting the purchase price, to the transport company/shipping company commissioned by us for the delivery of goods, and to our tax advisor to fulfill our tax obligations.
    • After an aborted shopping process, the data stored by us will be deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored until the expiry of the tax retention period (7 years).
    • Our shop is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify's data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.
  2. Data Security
    • To protect your personal data, we take appropriate organizational and technical measures. These precautions particularly concern protection against unauthorized, unlawful, or accidental access, processing, loss, use, and manipulation.
    • Notwithstanding efforts to always maintain an adequately high level of due diligence, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by others.
    • If you provide us with your credit card data, the information will be encrypted using Secure Socket Layer (SSL) technology and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
Your payment data is transmitted encrypted over the Internet during the ordering process.
    • You should always treat your access information confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others.
    • Please note that we therefore assume no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g., hacking of email account or telephone, interception of faxes).
  3. Transfer of Data to Third Parties
  • In general, the third-party providers we use will only collect, use, and disclose your data to the extent necessary to perform the services they provide.
  • Your data will only be forwarded on the basis of the GDPR, in particular for the fulfillment of your purchase or due to your prior consent.
  • Please note in particular that certain providers are located outside your country. The level of data protection in other countries may not correspond to that in Austria.
  • Should you choose to make a purchase that involves the services of a third-party provider, your information may be subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, your personal data used to complete that transaction may be disclosed under United States law, including the Patriot Act. Once you leave our shop's website and are redirected to a third-party provider, you are no longer subject to these privacy policies or our website's terms of service.
  1. Disclosure of Data Breaches

We strive to ensure that data breaches are detected early and, if necessary, reported immediately to you or the competent supervisory authority, taking into account the respective data categories affected.

  1. Data Usage for Advertising Purposes
    • We use your data to improve and personalize your shopping experience. We use existing information for this purpose, e.g., about your internet connection, the device you use, operating system, date and time of visiting the homepage, or pages you have accessed, as well as information we have received from you.
    • You can object to the use of your personal data for advertising purposes at any time. An email to hello@mama-matters.com is sufficient.
  2. Newsletter
    • You have the option to subscribe to our newsletter via our website. For this, we need your email address and your declaration that you agree to receive the newsletter.
    • As soon as you have registered for the newsletter, we will send you an email with a link to confirm your registration.
    • You can cancel your newsletter subscription at any time. Please send your cancellation to the following email address: hello@mama-matters.com. We will then immediately delete your data in connection with the newsletter dispatch.
  3. Cookies
    • Our website uses so-called cookies. These are small text files that we transmit via our web server to the cookie file of the browser on your computer's hard drive.
    • We use cookies to make our offer user-friendly, more effective, and more secure. Some cookies remain stored on your device until you delete them. This allows our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our internet pages. The content of the cookies we use is limited to an identification number that no longer allows personal identification of the user. The main purpose of a cookie is to recognize visitors to the website.
    • Two types of cookies are used on this website:
    • Session cookies: These are temporary cookies that remain in your browser's cookie file until you leave our website and are automatically deleted after your visit.
    • Persistent cookies: For better user-friendliness, cookies remain stored on your device and allow us to recognize your browser on your next visit.
      • If you do not wish this, you can set your browser to inform you about the setting of cookies and only allow them in individual cases.
      • Disabling cookies may limit the functionality of our website.
      • Here is a list of cookies we use. We have listed them here so you can choose whether you want to opt-out of cookies or not.
    • session_id, unique token, sessional: allows Shopify to store information about your session (referrer, landing page, etc.).
    • shopify_visit: No data is stored, cookies only serve statistics to record the number of visits.
    • shopify_uniq: No data is stored, expires at midnight (relative to the visit) of the next day, stores information about the contents of your shopping cart.
    • secure_session_id: If the shop has a password, this determines if the current visitor has access.

    1. Web Analysis
      • Google Analytics
        • This website uses Google Analytics for web analysis. This is a service of Google Inc. ("Google"). Google Analytics uses "cookies". The information generated by this "cookie" about your use of this website (including your IP address) is transmitted to a Google server in the USA and stored there.
        • Google adheres to the privacy policy of the "US-Safe-Harbor" agreement and is registered with the "Safe Harbor" program of the US Department of Commerce. Google will use this information to evaluate your use of the website, to compile reports on website activities for us, and to provide us with other services related to website and internet use. We also use a pseudonymous assignment to track your usage across devices. However, no personal data is transmitted to Google.
        • Google may also transfer this information to third parties if required by law or if third parties process this data on behalf of Google. Google will not associate your IP address with any other data held by Google. You can prevent the installation of cookies by setting your browser software accordingly; however, please note that if you do this, you may not be able to use all the functions of this website to their full extent.
        • If you do not want information about your website visit to be transmitted to Google Analytics, you have the option to install a "deactivation add-on" for your browser.
        • In addition, we have made settings so that Google Analytics deletes the last part of the IP addresses of visitors to our website. This means that we do not come into possession of any data that would allow us to draw conclusions about your person.
        • You can object to the collection and storage of data by Google Analytics at any time by downloading and installing a browser add-on to deactivate Google Analytics for your browser.

Further information on this can be found at https://tools.google.com/dlpage/gaoptout?hl=de or at https://support.google.com/analytics/answer/6004245?hl=de (general information on Google Analytics and data protection).

    • Facebook Website Custom Audience

A pixel from Facebook Ireland Limited (Website Custom Audience pixel) is integrated into this website. This pixel collects pseudonymized information about your use of this website (e.g., information about viewed articles). The collected information can be used to advertise to you individually, e.g., on your Facebook account, with preferred product categories and products.

    • Use of Facebook Social Plugins
      • This website uses so-called social plugins ("plugins") of the social network Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with a Facebook logo or the addition "Social Plugin of Facebook" or "Facebook Social Plugin". An overview of the Facebook plugins and their appearance can be found here: https://developers.facebook.com/docs/plugins
      • When you access a page of our website that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the website by it.
      • By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged into Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.
      • If you are logged into Facebook, Facebook can directly associate the visit to our website with your Facebook account. If you interact with the plugins, for example, by clicking the "Like" button or leaving a comment, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and shown to your Facebook friends.
      • Facebook may use this information for the purposes of advertising, market research, and needs-based design of Facebook pages. For this purpose, Facebook creates usage, interest, and relationship profiles, e.g., to evaluate your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website, and to provide other services associated with the use of Facebook.
      • If you do not want Facebook to associate the data collected via our website with your Facebook account, you must log out of Facebook before visiting our website.
      • The purpose and scope of data collection and the further processing and use of data by Facebook, as well as your related rights and setting options for protecting your privacy, can be found in Facebook's privacy policy: https://www.facebook.com/policy.php
    • Use of YouTube Plugins
      • Videos from the YouTube portal, a company of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), are embedded on our website. When you play a video, a connection to the YouTube or Google servers is established. This transmits to these servers which of our internet pages you have visited. If you are logged in to YouTube as a member, YouTube assigns this information to your personal user account.
      • The purpose and scope of data collection and the further processing and use of the data by Google or YouTube, as well as your related rights and setting options for protecting your privacy, can be found in Google's privacy policy: google.de/intl/de/policies/privacy/.
